Article 35 of the Food Safety Law of the People's Republic of China The State applies a licensing system to food production and marketing. Anyone engaged in food production, food sales or catering services shall obtain a license according to law. However, the sale of edible agricultural products does not require a license.
The food and drug regulatory department of the local people's government at or above the county level shall, in accordance with the provisions of the Administrative Licensing Law of the People's Republic of China, examine the relevant materials submitted by the applicant as required by the provisions of items 1 to 4 of paragraph 1 of Article 33 of this Law, and carry out on-site verification of the production and business premises of the applicant when necessary; Permission shall be granted to those who meet the prescribed conditions; Those who do not meet the prescribed conditions shall not be granted permission and shall state the reasons in writing. The date of issuance of a food production license is the date on which the licensing decision is made and is valid for 5 years.
Food Safety Law of the People's Republic of China Article 122 Anyone who, in violation of this Law, engages in food production or marketing without obtaining a food production or marketing license, or engages in food additive production without obtaining a food additive production license, The food and drug regulatory departments of the people's governments at or above the county level shall confiscate the illegal gains, the illegal food and food additives and the tools, equipment, raw materials and other articles used in the illegal production and marketing; If the value of food or food additives illegally produced or marketed is less than 10,000 yuan, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall also be imposed; If the value of the goods is not less than 10,000 yuan, a fine of not less than 10 times but not more than 20 times the value of the goods shall be imposed.
Food production license application and acceptance
To apply for a food production license, one shall first obtain a business license and other legal subject qualifications.
Enterprises as legal persons, partnership enterprises, sole proprietorship enterprises, individual industrial and commercial businesses, etc., shall take the subject specified in the business license as the applicant.
An application for a food production license shall be submitted in accordance with the following food categories: Processed grain products, edible oils, fats and oils and their products, condiments, meat products, dairy products, beverages, convenience foods, biscuits, canned foods, frozen drinks, frozen foods, potatoes and puffed foods, confectionery products, tea and related products, alcoholic drinks, vegetable products, fruit products, stir-fried foods and nut products, egg products, cocoa and roasted coffee products, Sugar, aquatic products, Starch and starch products, pastries, soy products, bee products, health food, special medical formula food, infant formula food, special dietary food, other food, etc.
What are the requirements for applying for a food production license:
(1) Having food raw material handling and food processing, packaging, storage and other places suitable for the variety and quantity of food produced, keeping the environment of the place clean and tidy, and keeping a prescribed distance from toxic and harmful places and other sources of pollution.
(2) having production equipment or facilities appropriate to the variety and quantity of food produced, and corresponding equipment or facilities for disinfection, changing clothes, washing, lighting, ventilation, corrosion prevention, dust prevention, fly, rat and insect prevention, washing, waste water treatment and garbage and waste storage; Health food production process has raw material extraction, purification and other pre-treatment processes, it is necessary to have raw material pre-treatment equipment or facilities commensurate with the variety and quantity of production.
(3) There are full-time or part-time food safety administrative personnel and rules and regulations to ensure food safety.
(d) with a reasonable equipment layout and process flow, to prevent the food to be processed and directly imported food, raw materials and finished products cross-contamination, to avoid food contact with toxic, unclean things.
(5) Other conditions stipulated by laws and regulations.
What materials do I need to submit for a food production license?
To apply for a food production license, the following materials shall be submitted to the local food and drug regulatory department at or above the county level where the applicant is located:
1. Application for food production license;
2. Copy of business license;
3, food production and processing site and its surrounding environment plan, layout plan of each function area, layout diagram of process equipment and food production process flow chart;
4, food production main equipment, facilities list;
5, purchase inspection records, production process control, factory inspection records, food safety self-inspection, health management of employees, unsafe food recall, food safety accident disposal and other rules and regulations to ensure food safety.
6, the applicant entrusts others to handle the food production license application, the agent shall submit a power of attorney and the agent's identity documents.
7, the applicant shall truthfully submit the relevant materials to the food and drug administration department and reflect the true situation, be responsible for the authenticity of the application materials, and sign or seal the application and other materials.
8, to apply for the production license of health food, special medical use formula food, infant formula food, it should also submit the production quality management system documents suitable for the food produced and the relevant registration and filing documents.
9, engaged in food additive production activities, shall obtain food additive production license in accordance with the law. To apply for a license for the production of food additives, premises, production equipment or facilities, food safety management personnel, professional and technical personnel and management systems that are suitable for the varieties of food additives produced shall be available. To apply for a food additive production license, the following materials shall be submitted to the local food and drug regulatory department at or above the county level where the applicant is located:
(A) food additive production license application;
(2) a copy of the business license;
(C) food additive production and processing site and its surrounding environment plan and production and processing of the layout of the functional areas;
(4) List of main equipment and facilities for food additive production and layout diagram;
(5) food additive safety self-inspection, purchase inspection records, factory inspection records and other rules and regulations to ensure the safety of food additives.
Reissue and cancellation of food production license
Article 32 Within the validity period of the food production license, where changes occur in the layout of the existing process equipment and process flow, major production equipment and facilities, food categories, etc., and the permitted items specified in the food production license need to be changed, the food producer shall, within 10 working days after the change, file an application for change with the food and drug regulatory department that originally issued the license.
If the production site is moved out of the jurisdiction of the food and drug regulatory department that issued the license, it shall apply for a new food production license.
If the items in the same food category and the address of the peripheral warehouse specified in the copy of the food production license are changed, the food producer shall report to the food and drug regulatory department that issued the license within 10 working days after the change.
Article 33 An application for changing a food production license shall submit the following application materials:
(1) Application for change of food production license;
(2) The original and duplicate of the food production license;
(3) Other materials related to changes in food production license items.
Article 34 If a food producer needs to extend the validity period of the food production license obtained according to law, he shall, 30 working days before the expiration of the validity period of the food production license, file an application with the food and drug regulatory department that originally issued the license.
Article 35 To apply for the renewal of food production license, a food producer shall submit the following materials:
(1) Application for renewal of food production license;
(2) The original and duplicate of the food production license;
(3) Other materials related to the renewal of the food production license.
Health food, special medical use formula food, infant formula food production enterprises to apply for the continuation of food production license, should also provide a self-inspection report on the operation of the production quality management system.
